1. General Terms

By visiting this website and using the services of SECAN Bilişim Teknolojileri Limited Şirketi ("SECAN"), you agree to the following terms. If you do not accept these terms, please do not use our website.

2. Services

SECAN provides web development, e-commerce, design, software consulting, and WhatsApp Business Assistant (SaaS) services. The scope, duration, and pricing of our services are determined per project and confirmed in a written agreement.

Note: SECAN is not a hosting company and does not provide hosting infrastructure. Under our "Website Maintenance" services we manage our customers' existing hosting accounts; the hosting infrastructure itself is provided by third-party providers. Continuity, performance, and availability of the hosting service are the responsibility of the relevant hosting provider.

3. Intellectual Property

All content, design, logos, text, graphics, and other materials on this website are SECAN's intellectual property and are protected by copyright. Unauthorised use is prohibited in the following cases:

  • Copying, reproducing, or distributing website content
  • Use for commercial purposes
  • Modification or creation of derivative works

4. Project Delivery and Acceptance

Project delivery timelines and conditions are set out in the per-project contract. The customer is responsible for reviewing the delivered project and providing feedback within the specified period. Projects not objected to within the specified period are considered accepted.

5. Payment Terms

Payment terms are specified in the project contract. Our general payment terms:

  • 50% upfront at project start
  • 50% on delivery
  • Payments via bank transfer or EFT
  • Statutory interest applies on late payments

6. Cancellation and Refund Policy

If a project is cancelled after it has started, a fee is charged for work completed up to that point. Unless otherwise stated in the project contract, upfront payments are non-refundable. Additional costs arising from customer-caused delays are borne by the customer.

7. Warranty and Liability

SECAN warrants that delivered projects conform to the specifications set out in the contract. However, SECAN is not liable for:

  • Data loss caused by the customer
  • Outages of third-party services (hosting, domain, APIs)
  • Unauthorised changes made by the customer
  • Natural disasters or force majeure

8. Privacy and Data Protection

SECAN values the confidentiality of customer information and complies with KVKK (Turkish data protection law) and GDPR. All information obtained during a project is kept confidential and not shared with third parties without customer consent. For details see our Privacy Policy.

9. Maintenance and Support

Free support is provided for a defined period after project delivery. This period is set out in the project contract. Ongoing maintenance and support is available under separate maintenance agreements.

Our "Website Maintenance" subscription plans cover management of the customer's existing hosting account, SSL certificate tracking, content updates, security monitoring, and technical support. These plans do not include hosting infrastructure or server resources. The customer is responsible for contracting separately with a third-party hosting provider.

10. WhatsApp Business Assistant (SaaS) — Specific Terms

SECAN provides a WhatsApp Business Cloud-based AI customer-service SaaS under the "Assistant" brand. The following specific terms apply to business customers ("Customer") using this service:

10.1. Customer's obligations:

  • Complete Meta business verification and WhatsApp Business Cloud API registration in Meta Business Manager.
  • Comply with Meta's WhatsApp Business Policy and Commerce Messaging Policy.
  • The Customer is responsible for the accuracy and currency of the knowledge base (products, prices, FAQ) uploaded to the Assistant. The Assistant generates replies based only on this information.
  • Compliance with KVKK/GDPR obligations toward end-users (the Customer's own customers) is the Customer's responsibility. SECAN acts only as a data processor in this service.
  • Not to use the Assistant for spam, fraud, illegal content, or any use prohibited by WhatsApp. SECAN reserves the right to suspend an account if such use is detected.

10.2. SECAN's obligations:

  • Keep the Assistant infrastructure operational (target uptime: 99%). Planned maintenance windows are announced in advance.
  • Acknowledge inbound WhatsApp messages within Meta's 5-second webhook window; the final reply delivery depends on Meta and the AI provider's response time.
  • Store the Customer's Meta access token encrypted (AES-GCM).
  • Keep conversation logs confidential, not sell to third parties, not use for AI model training.

10.3. Disclaimer regarding AI-generated replies: Replies generated by the Assistant are produced by a large language model (Claude / Anthropic). These replies may at times be incorrect, incomplete, or out of context. The Assistant is not designed to provide medical, legal, or financial emergency advice. The Customer is responsible for configuring escalation rules to route critical customer requests to a human operator. SECAN is not liable for commercial losses or misinformation arising from replies generated by the Assistant.

10.4. Pricing and quotas: Pricing for the Assistant service is as set out on Bionluk or in the contract. The monthly maintenance fee includes a specific message quota; overage charges apply above that. Fees charged by Meta via the WhatsApp Cloud API (marketing template messages, etc.) are paid by the Customer directly to Meta and are not included on SECAN's invoice.

10.5. Termination: The Customer may terminate the Assistant service at any time by email notice. After termination, the Customer's data is deleted within 30 days; summarised billing records are retained for the statutory retention period.

11. Dispute Resolution

For disputes arising from this agreement, amicable discussions are preferred. Failing agreement, the Courts and Enforcement Offices of Antalya, Turkey have jurisdiction.

12. Changes

SECAN reserves the right to amend these Terms of Service at any time. Changes take effect when published on the website. By continuing to use our website, you accept the updated terms.
